PBI BANK, INC. v. CHARLES RICKEY JOHNSON; TERESA JOHNSON By Virtue of Judgment In The Case Set Forth Below: I shall sell to the highest and best bidder at the time and place above, the following real estate and improvements thereon in Barren County, Kentucky, to wit:
To be sold in three separate sales: 998 H. Johnson Road and Tract H. Johnson Road (being sold together) 84.12 +/- acres with barn PVA #124- 33D and 54.88 +/- acres with barn PVA #124-33
3749 and 3623 New Bowling Green Road (being sold together)
37.51 +/- acres with house PVA #63-55 106 Rogers Road
Lot and Building PVA #G10-1-15A
For the purchase price, purchaser may pay cash, or may pay 10% of the purchase price in cash, with the balance of the purchase price secured by a purchase money bond due in thirty (30) days, with good and approved surety on the bond, and bearing interest at the rate of 12% per annum from date of sale until paid, said bond to have the same force and effect as a judgment and remain a prior and superior lien on the property until fully paid.
The property shall be sold with the im-provements thereon, “as is” and specif-ically subject to easements, restrictions and stipulations of record, assessments for public improvements levied against the property, and any facts which an inspection and accurate survey of the property may disclose. Bidders shall be prepared to promptly comply with the terms of sale; purchaser shall pay property taxes due for 2016 and follow-ing years. The buyer of the property shall be subject to a six percent (6%) buyer’s premium.
The judgment authorizing the sale is a Judgment and Order of Sale in Barren Circuit Court Civil Action No. 15-CI-555, PBI Bank, Inc. vs. Charles Rickey Johnson; Teresa Johnson to recover in rem for Note 1 the amount of $39,441.87, together with interest at the rate of $5.6596 per diem from November 23, 2015 until paid, to re-cover in rem for Note 2 the amount of $828,405.82, together with interest at the rate of $87.3288 per diem from November 23, 2015 until paid and to recover in rem for Note 3 the amount of $7,485.74 together with interest at the rate of $0.8677 per diem from Novem-ber 23, 2015 until paid, including attor-ney’s fees approved by the court, and costs herein expended.
