LEGAL NOTICE COMMISSIONER’S SALE Tuesday, March 22, 2016 at 12:00 Noon At The Courthouse Door, Barren County Courthouse (Judicial Center) Courthouse Square, Glasgow, Kentucky “Courthouse Square, Glasgow, Kentucky ” South Central Bank, Inc. v. Peter Fauber, Et Al By Virtue of Judgment In The Case Set Forth Below: I shall sell to the highest and best bidder at the time and place above, the following real estate and improvements thereon in Barren County, Kentucky, to wit: Legal Description: Containing 5.938 acres, more or less, as shown on the plat of said property recorded in Plat Book 13, Page 511, Office Barren County Clerk. Includes a 2002 Fleetwood Mobile Home (SN TNFL127AB25049). PVA # 29-7M-L1/36611 Being the same property conveyed to Rachel Fauber, single, by deed dated January 25, 1997, from James and Diana Bush, husband and wife, and recorded in Deed Book 236, Page 35, Office Barren County Clerk, and further conveyed to Peter Fauber, married, and Rachel Shields, married, by deed dated May 15, 2008, and recorded in Deed Book 313, Page 127, Office Barren County Clerk. Also known as: 94 Mammoth Cave Loop, Cave City For the purchase price, purchaser may pay cash, or may pay 10% of the purchase price in cash, with the balance of the purchase price secured by a purchase money bond due in thirty (30) days, with good and approved surety on the bond, and bearing interest at the rate of 12% per annum from date of sale until paid, said bond to have the same force and effect as a judgment and remain a prior and superior lien on the property until fully paid. The property shall be sold with the improvements thereon, “as is”. Bidders shall be prepared to promptly comply with the terms of sale; purchaser shall pay property taxes due for 2016 and following years. Any interested or prospective purchasers prior to the day of sale, shall, upon giving the current owners or those who are currently legally in possession of the premises which are the subject of this action 24 hours advance notice, be entitled to view and inspect the premises. The judgment authorizing the sale is a Judgment and Order of Sale in Barren Circuit Court Civil Action No. 13-CI-436, South Central Bank, Inc. to recover the amount of $89,869.11, together with interest at the rate of $14.5583 per diem from December 30, 2015 until paid, including attorney’s fees to be approved by the court, and costs herein expended.
